Terms & Conditions, Cancelation Policy and Payment Agreement
Please Note: Children must be older than 5 years old to go on an ATV, UTV, JET SKI, PADDLE
BOARD, and/or Kayak tour, 15 and under must ride as passenger on UTV tours, 15 years of age
can operate a JET SKI on tour with an Adult on the same JET SKI. Clients 16 years and older
can drive their own ATV, UTV and JET SKI with proof a valid driver license.
Cancellation Policy
If you cancel your tour 72 hours or more prior to your reservation date and time of tour, you will
not be charged a cancellation fee.
If you cancel your tour less than 72 hours from your reservation date and time of tour, we reserve
the right to charge the full price of the tour to the credit card you used when booking your tour.
If you don’t show up for your reservation, we reserve the right to charge the full price of the tour to
the credit card you used when booking your tour.
Please Note: When booking a tour online, your credit card is only used as a deposit to hold your
position; you are NOT charged at the time of booking. If you do not show up for your tour, we
reserve the right to charge the full price of the tour to the credit card you used when booking your
tour. Please pay for your tour in cash when you arrive at our office or present the credit card for
processing.
Payment Information
Collection Agreement is between Customer and Hot Wheels Island Tours LTD
• Collection of Payment Information
1.1 Customer agrees to provide Company with payment information, including credit card details,
for the purpose of payment for booking a tour (hereinafter referred to as the “Tour”).
1.2 Company undertakes to process and store payment information in accordance with applicable
laws Turks and Caicos Islands BWI, including but not limited to the relevant data protection and
privacy laws.
• Cancellation of Booking
2.1 In the event of cancellation of the Tour booking, Customer agrees to notify Company in writing
within the specified timeframe as outlined in the booking terms. In case of late notification or
failure by the Customer to meet the cancellation conditions, Company reserves the right to
impose a Fee of 100% of the Customers Booking.
2.2 Company has the right to withhold a certain amount from Customer’s payment information to
cover expenses incurred as a result of the booking cancellation.
• Damage to or Loss of Vehicles
3.1 Customer agrees to handle the vehicles and/or equipment (ATV, UTV, JET SKI, PADDLE
BOARD, KAYAK) with due care and abide by the safety rules provided by the Company. In the
event of damage or loss of the vehicles and/or equipment due to improper use or non-compliance
with the rules, Company has the right to charge the Customer’s credit card to cover the expenses
for repair or replacement of the vehicles, Jet Ski’s and/or equipment Reserved, Booked or
Rented, as well as property owned, leased, rented, or contracted by Hot Wheels Island Tours
LTD.
3.2 Company assesses the cost of damages or loss, Customer agrees to pay the full amount due
using the provided payment information and/or additional payment methods to settle the debt
prior to departing Turks and Caicos Islands.
• Liability for Payment Information
4.1 Customer acknowledges that the payment information provided to Company is accurate,
complete, and up-to-date and will provide additional payment method details upon request.
4.2 Customer bears full responsibility for any errors or inaccuracies in the payment information
provided, including incorrect or invalid credit card details.
• Confidentiality
5.1 Company agrees to process payment information in compliance with applicable data
protection and privacy laws. Company undertakes not to disclose such information to third
parties, except as required by applicable laws or with the Customer’s consent.
• Acceptance of Terms

6.1 By clicking the “Book Now”, “Agree”, “Accept”, “Consent” button on the Company’s website,
Customer signifies their full acceptance of the terms of this agreement.
6.2 Customer confirms that they have read and understood the terms of this agreement and
agree to abide by them.

Hot Wheels Island Tours LTD
RENTAL POLICY AGREEMENT
Between HOT WHEELS ISLAND TOURS LTD (hereinafter referred to as "the Company") and Renter
(herein after referred as the name on the Reservation Request Form along with any Passengers, Riders,
Drivers, and/or Guests related to the Renter Reservation, Booking, Contracts and/or Agreements).
This Release of Liability Contract (hereinafter referred to as "the Rental Policy Agreement and/or
Contract") is entered into between the Company and the Renter for the Equipment, otherwise known as
Motor Vehicle, Non-Motor Vehicle, ATV, UTV, Jet Ski, Paddle Board, Kayak, and all owned equipment,
as well as all leased, contracted, sub-contracted and rented (hereinafter referred to as “the Equipment”).
The purpose of this Contract is to define the terms and conditions under which the Renter assumes
responsibility and releases the Company from certain liabilities while using the Equipment.
The Renter acknowledges and accepts the following responsibilities:
• To use the Equipment in compliance with all applicable laws and regulations.
• To return the Equipment to the Company in the same condition as received.
• To bear the cost of any damage, loss, or theft of the Equipment during the rental period, including but
not limited to repairs, replacement, or deductible amount.
• To be responsible for any operating violations incurred while in possession of the Equipment.
The Renter hereby releases the Company and its employees, agents, representatives, and affiliates
from any liability for any claims, damages, losses, or expenses arising out of the use or operation of the
Equipment. This release of liability includes, but is not limited to, claims for personal injury, property
damage, or any other loss or harm.
The Renter agrees not to make any alterations, modifications, or additions to the Equipment. Any
unauthorized changes will be at the Renter's expense, and the Renter will be held responsible for any
resulting damage or loss.
This Contract shall be governed by and interpreted in accordance law in force at the date hereof and as
currently applied by the Court of the Turks and Caicos Islands.
This Contract represents the entire agreement between the Company and the Renter and supersedes
any prior agreements or understandings, whether written or oral.
If any provision of this Contract is found to be invalid or unenforceable, the remaining provisions shall
remain in full force and effect.
The failure of either party to enforce any provision of this Contract shall not be construed as a waiver of
that provision or the right to enforce it.
The Renter acknowledges that they have read and understood this Contract and agree to its terms and
conditions.
